The second type is to acquire finances by raising money from personal and other sources external to the business without resorting to bank loans.


Yilmazer says that businesses that use owner resources and delay payments for household expenses are the ones that typically report a need for further financing for their businesses. Yilmazer says the recent recession has affected the direction of the resource flow from household to business and the owners might be putting their own assets at risk for the business.


"Recession has increased the risk of business failure," Yilmazer said. "Since business is inherently risky, financing with owner resources would seem to extend that risk to the household in ways that owners may not be adequately considering."


Yilmazer found that the use of financial resources is a two-way street in small and family-owned businesses, confirming that the family and business interact and resource exchanges occur in both directions. She says that while small businesses can provide income for households, owners need to be aware that financing a business from household funds opens the door for household assets to become susceptible to loss.


"Business ownership is an important household investment," Yilmazer said. "Ownership may serve as a source of income and expenses as well as an investment vehicle, but it is not generally understood or considered as a household portfolio risk. Robert and I just returned to the US this morning from another exhausting China trip (8+ meetings per day makes for early rises and late evenings), something we repeat about every other month. No surprise, but all indications on the ground, from meetings with various corporate / cap markets partners at top law firms in HK / China, we are still planted solidly in an economic and deal flow boom there.

We have been averaging about 2 US associate or counsel placements per week in Asia so far this year, a blistering pace that can’t continue quite frankly, but is an indicator of how hot the market is right now (see recent Asia Chronicles ATL posts for more details on this hiring boom or do a search at theasiachronicles.com for such info).

Just the fact that Robert and I can set up meetings on short notice with the leading corporate partners of top US and UK firms in HK / China (especially in a boom market where time is at a premium for such persons running multiple big deals on understaffed teams) is a major difference between Kinney and other recruiting firms trying to break into the increasingly hot US associate biglaw lateral hiring market in HK / China. Why would you want to put your job search in the hands of a recruiter with just a few or even zero US associate placements in HK / China, verses a recruiter with dozens and more than 30 in the past year?

Our best recruiters work with associates and partner candidates, not just partners. Robert Kinney and I have had success in placing partners and groups in HK / China, but we still work directly with associate candidates, along with our other Asia team recruiters, Alexis Lamb, Yuliya Vinokurova, Danielle Cyr and Peter Guttensohn. I mention this because at most recruiting firms, the best recruiters focus on partners and pass on associate candidates to less experienced and less successful recruiters. Sure, partner placements are much more lucrative, but Robert and I thoroughly enjoy working with and acting as long-term advisors for US associates in Asia and we will not stop doing so. For example, I have made on average about 30 US associate placements per year in Asia, even though I am moving partners as well.

We provide a long-term agent relationship with our associate client candidates, not simply a quick job search and resume distribution service. At Kinney, our Asia focused team starts working with a number of our associate candidate clients months and even years before they are ready for an Asia job search, in some cases those relationships go all the way back to the candidate’s law school years (when we offer advice on which 2L summer spot to take, regarding China practices at particular firms). Of course we also place plenty of US associates who start job searches in Asia immediately upon being referred to us, but many are already long-term relationships when a job search starts. We have also placed numerous US associates a second time in Asia, whether in-house or another law firm after a few years at their first firm in Asia.

Keep in mind that even if you are ready to start an Asia job search right away, even in this hot lateral market it can be a long process for some very qualified candidates. You can’t afford to entrust your job search and representation at various firms to a recruiter who simply emails your resume and hopes for the best. Robert and I, along with our other Asia recruiters, are personally involved in advocating for our candidates over the long-term, if need be. We are close with the relevant partners and can bring up your candidacy in person or by phone whenever it is appropriate to do so. It is not simply a case of emailing a resume and hoping for the best, with only being able to provide administrative services of coordinating interviews. It is quite shocking but that is all you are going to get from the vast majority of recruiters out there, despite what their 10 to 20 minute sales pitch may be upon meeting you.

Don’t lose sight of the fact that once you are submitted to a firm by a recruiter that recruiter unfortunately “owns” your candidacy at such firm for 6 months or more, causing most recruiters to focus on simply being able to make the submission, rather than provide a service.

Our Asia recruiters are on the ground in Asia and US, and all of our Asia team spends time in our New York and Hong Kong offices. It is not uncommon for a NYC based associate to call Kinney to start a job search and within a week both meet a Kinney Asia recruiter in NYC and for that same Kinney recruiter to be advocating for them on the ground in Asia, meeting in person with relevant partners in Asia on their behalf. No other recruiting firm can offer this because quite simply, we travel more than others do and happen to have offices in both US and Asia. We make it a point, for example, to have at least one recruiter on the ground in Hong Kong, 365 days a year.

This phenomenon has likely been driving advertisers to work with other avenues like Groupon, which can target individual regions or towns. Topix, meanwhile, has been making an average $4 eCPM (cost per thousand) for its advertising, says Tolles, and has also been getting much more response from large ad agencies than in the past.


Two to three years ago when a sales rep would call on some Madison Avenue firm, the 25-year-old sales guy would say “local sounds like my local news, and that sounds like my mom and dad — so no thanks.” Now they’re saying “local sounds like Foursquare and I have an iPhone and that sounds interesting, so yes.”


Local Advertising Rates are Climbing


The fact that CPMs for local advertising are up means that lots of companies like AOL and Yahoo — which is pursuing a Patch-like strategy with its Associated Content unit, which it acquired last year for an estimated $100 million — are going to be looking to amass as much content as possible so that they can get the scale necessary to make an impact on their businesses, the Topix CEO says. “It’s all about who can create a large local footprint,” he said. “I think we will see acquisitions this year, as part of a land grab from these companies, looking for someone who can deliver a large enough local footprint.”


Not surprisingly, Tolles says Topix is in a pretty good position if that happens. The local news aggregator was profitable for the first time in 2010, he says — with revenues that were up by more than 50 percent compared with the previous year. “We are one of the largest local sites in the U.S.,” the CEO says, “larger than any other except maybe one of the big newspaper chains like Gannett or McClatchy. Not bad for about 30 people in an office in Palo Alto [Calif.].” The site gets about 8 million uniques a month, he said, which is roughly the same as twice what AOL’s Patch is estimated to have across its sites.



Topix doesn’t get much attention when it comes to the online-media space, perhaps because it has been around so long. It was created in 2004 as an automated news aggregator by a team that included Rich Skrenta — who now runs Blekko — and Tolles. They used algorithms to crawl tens of thousands of news sites, blogs and other sources of information and then filtered it into topics. Over time, the company started to focus on location as the main filter, and categorized the information into more than 20,000 towns and cities. In 2005, it got a large investment from several media companies including Gannett Communications, the Tribune Co. and McClatchy.


News Is Easy — Community Is the Hard Part


And what does Tolles think about competing with Patch, as AOL pours more money into the hyper-local effort, which is now in close to a thousand different towns across the U.S.? The Topix CEO says his site doesn’t really compete with Patch in many locations yet — and when Patch has good content from a local area, “we can aggregate that too,” he says. In some ways, Topix approaches local news in the same way that The Huffington Post did with national and international news: the site pulls in and shows excerpts of stories from other news sites. But more important even than the news, says Tolles, is the fact that Topix gives readers from those areas somewhere to discuss the news.


“We started out as a news aggregator, but the thing that we have done a really good job of is giving people a place to come and talk about the content, the news from their local community” the Topix CEO says. During the mid-term elections, for example, the site created pages for every local race, all the way from sheriff to local city council. Across all of its pages, Topix gets about 4 million comments a month from readers, which is roughly the same as The Huffington Post.


“Patch may be able to set up thousands of sites in local towns, but it takes time to develop that kind of community — it doesn’t just happen overnight,” says Tolles.

For Every Entertainment Industry Job 'Lost' To Infringement, Could 12 Jobs Be Created Elsewhere?

For years we've debunked various entertainment industry studies claiming ridiculous job and economic "losses" from copyright infringement. These studies tend to have all sorts of problems; ignoring the ability to adapt and to introduce new business models, using "ripple effects" in just one direction to double, triple and quadruple count the same "losses" over and over again, and counting every download as a "lost sale." The ripple effects one is especially pernicious because the industry likes to pretend that the impacts of infringement only go in one direction. They ignore that the money not spent on such content doesn't disappear from the economy but can be used elsewhere -- perhaps in areas that provide greater economic growth.



A few years ago, the folks at CCIA smartly took the copyright industry's exact methodology and showed that for all the claims of how much copyright contributed to the economy, exceptions to copyright contributed even more. While the copyright maximalists totally missed the point and attacked the methodology -- not realizing that, in doing so, they had undermined their own methodology -- the point was made. If you believe the claims from the copyright industry, then you also have to believe that the exceptions are more important. The methodology is the same, so either neither are right or both are right.



It looks like Rick Falkvinge, of The Pirate Party, has now done something similar on the "job loss" side of things, and concluded that, using similar methodology to the industry reports, for every job "lost" by copyright infringement, the positive ripple effects in the other direction mean that 11.8 new jobs are created. So if we accept the claim that 1.2 million jobs can be lost due to infringement, it would mean that a separate 14.2 million jobs were created elsewhere.



The report broke down the "creative industry," by noting that (contrary to copyright maximalist claims), most of that industry doesn't actually rely on copyright to make money. In fact, certain "creative" industries could be seen as "copyright-inhibited." For example, advertising. As we constantly hear from copyright maximalists, various sites are making big bucks by using advertising in association with file sharing. So based on the industry's own argument, it seems that the advertising market is clearly copyright-inhibited, and it would grow if there was greater infringement. After going through the numbers, it was determined that the majority of GDP, by quite a bit, are likely in the "copyright-inhibited" arena.



Now, you can certainly argue with the methodology here. I don't think anyone actually believes these numbers are accurate. But it's using the same basic methodology, assumptions and thought processes behind the studies in the other direction. You can also, obviously, claim that Falkvinge is biased. He is. But is he more biased than the entertainment industry legacy players who do the other studies? It seems clear that the industries are likely to be more biased, since they have billions of dollars bet on keeping the old structures in place. I think both studies are probably far from accurate in all sorts of ways, but if you're going to cite the entertainment industry's claims based on this kind of methodology, it seems you should also have to accept these claims. Not doing so suggests serious cognitive dissonance or someone who is paid not to believe the truth.

Making Money Internet


According to a BusinessInsider interview, Gogo in-flight wireless is doing well and just raised another $35 million in capital to keep the lights on and the in-flight Wi-Fi flowing. Aircell, Gogo’s parent company, says that the service served 3 million sessions between Thanksgiving and New Year’s. Google offered free Gogo on all flights during this period.


In-flight Internet is, in a word, great. However, I worry that it is severely hampering my movie watching time these days as I’m encouraged to write and work during flights as opposed to read magazines and watch movie’s I wouldn’t normally watch with the lady wife like The Box and Pootie Tang. Gogo is available on American, United, Delta, Virgin America, and Air Canada and airlines love it, as Dan Frommer points out, “because it’s a way to distract passengers and generate revenue at the same time — unlike installing TV sets and on-demand movies, which costs money.”




I’m back. CPAC week came and went. Then another week came and went after the horrible cold I got at CPAC. But now I’m healthy again and it’s time to start catching up. Though there’s no way I’m going to post on every tidbit I’ve run across in the last two weeks, I can try to hit the highlights.


And let’s start with the fact that the Internet Kill Switch is back under a new name. Susan Collins and Joe Lieberman have reintroduced the bill under a new name. They think if they put freedom in the name that we’ll ignore the problems inherent in giving the President emergency powers to wage economic war on America. The Internet Kill Switch is a broken idea. We don’t let the President close supermarkets nationwide if one butcher in one city has an e. coli outbreak. We can’t apply the same overreaction online.



Also while I’ve been out of it, House Republicans have been busy. As I understand it, we’ve not only grilled the administration on the “Stimulus” spending on communications, but we’ve also passed an amendment to the continuing resolution in order to defund Net Neutrality. I love it. Our Energy and Commerce leadership in the House has so much going on, including Obamacare, but they seem to relish the opportunity to strike back so much and so hard at the administration’s illegal overreaching. From the cheap seats, Greg Walden, Fred Upton, and others are doing a great job.


Fun fact: when the House debated Net Neutrality defunding, the Democrats very strangely started making arguments that government should leave the Internet alone. Anna Eshoo said “I would not fool around with an open, accessible Internet.” Hey, for once we agree.


By the way, fun fact: Net Neutrality is so terrible for innovation and customer service that ISPs turned down ARRA money to try to stay away from it. Yes, they turned down free money from the government because regulation is just that costly.


Further, the Net Neutrality coalition continues to crumble. Collin Petersen, Democrat of Minnesota, flipped sides by voting for defunding NN after voting for NN last Congress. Perhaps he noticed the total wipeout in 2010 of PCCC candidates pledged to support Net Neutrality. Every single Democrat who signed the PCCC Net Neutrality pledge went on to lose in November.


Meanwhile, Julius Genachowski and the FCC still don’t get the message. He thinks he’s entitled to debate the Congress instead of taking orders. Greg Walden announced plans to pressure him on transparency, which should help teach him who’s boss, you’d think.


Though we have to give Genachowski credit on one thing: He admits the Netflix/Level 3/Comcast issue is not a violation of Net Neutrality.


Michael Copps, pet commissioner of neo-Marxists everywhere, deserves no credit though. He’s now pushing for more speech controls in the name of “disclosure.” It’s about control and gathering power in Washington.


The FCC still needs lots of oversight, though, as conflicts of interest continue to crop up, this time with an FCC official having PBS as an employer.


I have more to write on in the coming days on Google and Copyright, especially the Combating Online Infringement and Counterfeits Act (COICA) which threatens to continue the criminalization of copyright law in America and expands government online in the name of protecting a few big companies.
